Waiver & Release
PHOTO & VIDEO RELEASE
In consideration of being permitted to compete, perform, or participate in anyway in THE MAKING 2025, each of the undersigned, for him or herself, grants Maker Empire, Inc dba Elements Dance Space and its affiliates permission to photograph and record my performance, and hereby irrevocably transfers and assigns to Maker Empire, Inc dba Elements Dance Space, all rights to these photos and videos. Such rights shall include, without limitation, the right but not the obligation to use, adapt, or alter the Content, and to use, exploit, distribute, and advertise the Content, in any manner and in any and all media, whether known or hereafter devised, Maker Empire, Inc dba Elements Dance Space in its sole discretion shall determine.
WAIVER OF LIABILITY
Each of the undersigned, for him or herself, acknowledges that the activities of THE MAKING 2025 involved risk of serious injury and/or property damage. I assume full responsibility for any risk or bodily injury, death or property damage arising out of or related to THE MAKING 2025 whether caused by the negligence of releasees or otherwise.
The COVID-19 virus is a serious and highly contagious disease. The World Health Organization has classified it as a pandemic. You could contract COVID-19 from a variety of sources. Our studio wants to ensure you are aware of the additional risks contracting COVID-19 associated with being in the studio. The COVID-19 virus has a long incubation period. You may have the virus and not show symptoms and yet still be highly contagious. Determining who is infected by COVID-19 is challenging and complicated due to limited availability for virus testing.
By signing this agreement, I hereby acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to, or infected by COVID-19 by entering the venue and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at The Making 2025 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Maker Empire, Inc dba Elements Dance Space management, employees, volunteers, and other clients. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at The Making 2025.
I hereby release, covenant not to sue, discharge, and hold harmless Maker Empire, Inc dba Elements Dance Space, as well as all employees, agents, and representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Maker Empire Inc, dba Elements Dance Space, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after attending The Making 2025.
Maker Empire, Inc dba Elements Dance Space and its affiliates are not responsible and will not be held liable for any stolen or lost goods and/or personal items.
